A legal disclaimer

These Terms & Conditions ("Terms") govern your use of the F1inTO website, mobile application at go.f1into.ca, newsletters, social channels, registration and RSVP forms, waitlists, contests, watch parties, activations and any related service (together, the "Services").

By using the Services, you agree to these Terms. If you do not agree, do not use the Services. Some programs have their own specific terms, such as contest Official Rules, ticketing terms or volunteer agreements. Where those conflict with these Terms, the specific program terms apply.

1. Who we are

F1inTO is a brand and event series of Culture Cartel Inc., an Ontario corporation carrying on business as Culture Cartel Live ("Culture Cartel", "we", "us", "our"), based in Toronto, Ontario, Canada.

Every reference in these Terms to F1inTO means Culture Cartel Inc. operating under the F1inTO brand. Culture Cartel Inc. is the contracting party for all purposes.

Ownership and operation of the brand. F1inTO is a trade name, brand and event series wholly owned and operated by Culture Cartel Inc. It is not a separate legal entity, partnership, joint venture, association or independent business. Culture Cartel Inc. is the sole owner and operator of the brand and of everything that carries it.

All rights in the F1inTO name, logos, marks, get-up and creative assets, the domains f1into.ca and go.f1into.ca and any related domain, the website and mobile application, all social media accounts and handles, all event names, formats and concepts, all ticketing and platform accounts, all subscriber, customer, sponsor and partner data, and all goodwill generated by any of the foregoing, are owned exclusively by Culture Cartel Inc.

 

Nothing in these Terms, and no involvement with the Services in any capacity, including as an attendee, member, volunteer, contractor, collaborator, host, promoter, partner, sponsor or contributor, creates or transfers any ownership interest, licence, partnership, joint venture, agency, employment relationship, equity, revenue share or any present or future claim in the F1inTO brand, its assets, its accounts or its data. Any such right must be granted in a separate written agreement signed by an authorised officer of Culture Cartel Inc.

2. No affiliation with Formula 1 or the FIA

F1inTO is an independent fan and community platform. We are not affiliated with, endorsed by, sponsored by or connected in any official capacity to Formula One Management, Formula One Licensing B.V., the FIA, any Formula 1 team, driver, circuit, broadcaster or event promoter.

Any reference to races, teams, drivers, venues or series is descriptive and for identification only. We do not claim any rights in them.

"F1", "FORMULA 1", "FIA FORMULA ONE WORLD CHAMPIONSHIP", "GRAND PRIX" and related marks are trademarks of Formula One Licensing B.V. and its affiliates. All other trademarks and service marks belong to their respective owners.

3. Eligibility

You must be 19 or older to register, purchase tickets or enter contests, unless a specific program states otherwise. Some events carry age restrictions because of venue rules or alcohol service.

Where an event is family friendly and permits minors, a parent or guardian must register on the minor's behalf, accept these Terms for them and remain responsible for supervising them throughout.

You confirm that the information you give us is true and complete. We may cancel any registration, ticket or contest entry that is false, incomplete or ineligible.

 

4. Changes to these Terms

We may update these Terms at any time by posting a revised version with a new "Last updated" date. Material changes will be highlighted for a reasonable period. Continued use of the Services after an update means you accept it.

5. Registration, accounts and communications

You are responsible for the accuracy of the information you provide, for keeping it current, and for safeguarding your account credentials and any activity under your account.

Consent to communications. By registering for, entering or participating in any F1inTO experience, draw or offering, whether in person or through any of our digital properties, you consent to receive communications from us about the Services. This includes transactional, informational and commercial electronic messages sent to any address, number or messaging account you provide, including by email, SMS and messaging platforms such as WhatsApp.

You may withdraw consent to commercial electronic messages at any time by using the unsubscribe link in any email, replying STOP to any message, or writing to info@culturecartel.ca We may still send essential transactional notices such as booking confirmations and event changes.

6. Privacy and data ownership

Personal information is handled in line with our Privacy Policy, which explains what we collect, why, how long we keep it and your rights.

All data collected through the Services, including contact details, subscriber and mailing lists, attendance and engagement history, ticketing and transaction records, sponsor and partner data, analytics data, user submitted content and all data derived from any of it, is collected by and is the sole property of Culture Cartel Inc.

 

Culture Cartel Inc. is the data controller for all purposes under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Canadian privacy law. No other individual, partnership, contractor, volunteer or affiliated party holds any ownership interest, licence, beneficial right or future claim to that data, regardless of any role they play or have played in the operation of F1inTO.

7. Reservations, tickets and waitlists

Some events are free with RSVP. Others require paid tickets. Your confirmation email is proof of reservation. Bring valid ID.

A reservation, RSVP or waitlist position is not a guarantee of admission, seating, age eligibility or any specific amenity. Seating is not reserved unless we say so. We may adjust capacity, layout or venue for safety and operational reasons.

We may change, postpone or cancel any event for any reason, including weather, safety, venue issues or circumstances beyond our control. Where the law or the specific offer requires it, we will provide a refund or credit. Otherwise all sales are final.

Tickets may not be resold or transferred without our consent, unless the ticketing platform and applicable law permit it.

8. Events and venues

Event details, schedules, capacities, broadcast availability including full sound, and features can change without notice and are often controlled by third party venues or broadcasters. Listings on our site are not guarantees.

 

Many events take place at venues we do not operate. Venue rules, entry conditions and security procedures apply, including ID checks and bag screening. We may refuse or revoke admission for safety, capacity or policy reasons, without refund where the law permits.

Where alcohol is served, legal ID is required. We or the venue may refuse service or entry to anyone believed to be intoxicated or underage.

Recording or live streaming is not permitted where the venue or broadcaster prohibits it. Commercial filming or photography requires our written consent.

 

9. Health, safety and assumption of risk

You agree to follow all posted and announced safety instructions, health policies and security directives. If you are unwell, do not attend in person. We may introduce health screening or policies where required by law, by a venue, or by reasonable safety practice.

BY ATTENDING OR PARTICIPATING IN ANY EVENT, ACTIVATION, TRACK EXPERIENCE, SIMULATOR SESSION OR RELATED ACTIVITY (COLLECTIVELY, "EVENTS"), YOU UNDERSTAND AND VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, PROPERTY DAMAGE AND LOSS ARISING FROM OR RELATED TO THE EVENTS, INCLUDING RISKS FROM CROWDING, NOISE, TRAVEL, WEATHER, EQUIPMENT AND THE ACTIONS OR OMISSIONS OF OTHERS.

 

10. Release and indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU, AND ON BEHALF OF YOUR HEIRS AND ASSIGNS, RELEASE, WAIVE AND FOREVER DISCHARGE CULTURE CARTEL INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AGENTS AND PARTNERS (THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS AND EXPENSES OF ANY KIND, IN LAW OR IN EQUITY, ARISING OUT OF OR RELATING TO THE EVENTS OR YOUR USE OF THE SERVICES, INCLUDING ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

This release does not apply to liability that cannot lawfully be excluded or waived under Ontario or federal law, and does not release liability caused by gross negligence, wilful misconduct or intentional wrongdoing.

You agree to indemnify, defend and hold harmless the Released Parties from any third party claim or liability, including reasonable legal fees, arising from your breach of these Terms, your conduct at an Event, or content you submit. This does not apply to the extent the claim is caused by the gross negligence or wilful misconduct of the Released Parties.

11. Photo, audio and video release

By entering an Event space, you grant Culture Cartel Inc. a worldwide, perpetual, royalty free licence to record, photograph and use your image, voice and likeness for editorial, promotional and archival purposes in any media, without further notice or compensation, to the extent permitted by law.

If you prefer not to be recorded, tell our staff on arrival. We will make reasonable efforts to accommodate you, but we cannot guarantee exclusion from all media.

12. User content and code of conduct

If you post or submit content to us, including photos, comments and testimonials, you grant us a non exclusive, worldwide, royalty free licence to use, reproduce, modify and display that content for F1inTO purposes.

You confirm that you own the content you submit or have the rights to submit it, that it does not infringe anyone else's copyright, trademark, privacy or publicity rights, and that it contains nothing unlawful. You agree to indemnify us against any claim arising from content you submit. We may remove any submitted content at any time.

No harassment, hate, threats, discrimination or illegal conduct. We may remove anyone behaving in a disruptive or unsafe way, and we may remove any content at our discretion.

13. Contests, giveaways and promotions

We may run contests and giveaways from time to time. Each one has Official Rules posted at the point of entry. Those Official Rules prevail over anything on the site or in these Terms that conflicts with them.

Unless the Official Rules say otherwise:

  • Open to legal residents of Ontario aged 19 or older at the time of entry. Void where prohibited.

  • No purchase necessary. A purchase does not improve your chances of winning.

  • Entry methods are set out in the Official Rules.

  • Prizes are not transferable and there is no cash substitution unless we choose to offer one. Odds depend on the number of eligible entries.

  • Potential winners must meet eligibility requirements, sign a declaration and release, and correctly answer a time limited mathematical skill testing question. If a potential winner is ineligible or does not respond, we may select an alternate.

  • Except where prohibited, winners consent to the use of their name, city, likeness and statements for promotional purposes without further compensation.

  • Winners are responsible for any taxes or fees associated with a prize.

  • We may cancel, modify or suspend a contest if fraud, technical failure or any other factor affects its integrity or proper operation, as reasonably determined by us.

 

14. Volunteers

Volunteers are not employees, partners or agents of Culture Cartel Inc. and are not entitled to wages, benefits or employment protections beyond those that apply by law. We may reimburse pre approved expenses against receipts.

Volunteers must follow instructions, complete any required training and use provided safety equipment. We may reassign or end a volunteer role at any time.

Volunteers may be exposed to non public information. That information must be kept confidential and all materials returned on request.

To the maximum extent permitted by law, volunteers assume the inherent risks of volunteer activity and are covered by the release and indemnity in Section 10.

15. Content, intellectual property and third party material

Our content. The F1inTO name, marks, branding, original text, graphics, layout, code, photography and video produced by or for us are owned by Culture Cartel Inc. You may not copy, reproduce, distribute or create derivative works from them without our written permission.

Third party content. The Services feature and reference content owned by other people, including images, footage, artwork, logos, editorial material and audio relating to Formula 1, its teams, drivers, circuits, broadcasters, venues, sponsors, partners and community members. That content remains the property of its respective owners. We claim no ownership, copyright, licence or endorsement in it. It appears on the Services for identification, commentary, review, news reporting and to promote the work of the owners, and it is not used to suggest any affiliation or official status.

Content supplied to us. Where content is supplied to us by a venue, sponsor, partner, contributor or user, we rely on that party's representation that it owns or is licensed to use that content and that it has the right to grant us permission to publish it. That party remains responsible for the content it provides and agrees to indemnify us against any claim arising from it.

Notice and takedown. If you own rights in content that appears on the Services and you believe it has been used without permission, contact us at info@culturecartel.ca with your name and contact details, a description of the work, the URL or location where it appears, and a statement that you are the rights holder or authorised to act for them. We will review the notice promptly and remove or credit the content where appropriate. We would rather fix it than argue about it, and we will act on a good faith notice without requiring a formal legal claim.

16. Third party services and links

We may link to third party websites, ticketing platforms, maps or social channels. These are provided for convenience. We do not control them and are not responsible for their content, policies or availability. Your use of them is at your own risk and governed by their terms and privacy policies.

17. Accessibility and human rights

We aim to deliver accessible services consistent with the Accessibility for Ontarians with Disabilities Act (AODA). If you need an accommodation, contact us at info@culturecartel.ca in advance so we can plan for it. We do not tolerate harassment or discrimination prohibited by applicable human rights law.

18. Information on the site

The Services provide general information about fan events, watch parties, community activities and related news. Any decision you make based on that information is your responsibility.

We aim to keep information accurate and current, but we do not promise that the Services are error free, complete or up to date. We may correct, update or remove content at any time without notice, and we do not undertake to update statements except where the law requires it.

19. No warranties

The Services and Events are provided on an "as is" and "as available" basis, without warranties or conditions of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non infringement, availability or security, to the extent permitted by law.

20. Limitation of liability

To the maximum extent permitted by law, Culture Cartel Inc. and its directors, officers, employees, volunteers, contractors and agents will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for lost profits, arising from or related to your use of the Services, third party links or services, or your reliance on any content.

In all cases, our total liability to you for any claim relating to the Services will not exceed CAD $100 or the amount you paid us in the twelve months before the claim, whichever is greater.

Nothing here limits liability that cannot lawfully be limited.

21. Events beyond our control

 

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including severe weather, fire, flood, power or network failure, labour disruption, illness or public health measures, venue closure, broadcast failure, government order, civil unrest or acts of terrorism.

22. Suspension and termination

We may suspend or terminate your access to the Services, cancel a reservation, or refuse admission at any time where we reasonably believe you have breached these Terms or where it is necessary for the safety of attendees, staff or a venue.

23. General

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these Terms. We may assign ours to an affiliate or successor. These Terms, together with our Privacy Policy and any applicable program terms, form the entire agreement between you and us regarding the Services.

24. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute relating to the Services will be brought exclusively in the courts located in Toronto, Ontario.
